The present thesis aims to understand the role of the judiciary within the dynamic and complex implications of fake news in the democratic system, increasingly marked by polarization and a constant war of narratives. The study is justified in the contemporary scenario in which the production of fraudulent information has repercussions in an informational scenario that does not value quality and correctness, but the results in the dispute for power. What happens within the philosophical conception of the post-truth and the distribution of content through algorithms on the internet making disinformation a phenomenon of different shades, difficult to solve and worrying effects. The context stimulated the starting question is: what are the legacies of the electoral justice decisions on fake news in the 2018 general elections, which were marked by digital information disorder? It is an unprecedented study in view of its theoretical and methodological compositions drawn in five chapters that promote interdisciplinary dialogues between the fields of law, communication, political science, philosophy, technology and linguistics. The concerns of the question make the general objective of understanding the role of Superior Electoral Court in the face of the spread of electoral fake news. In order to answer the questions of the thesis, a quantitative and qualitative deductive method was chose, using bibliographic sources and documentary research, in addition to the jurisprudential empirics carried out with the help of the Google Docs form, the Iramuteq software and the content analysis technique. It starts from the hypothesis that the Brazilian judiciary must use systemic and complex perspectives to deal with the phenomena of digital fraud. It is concluded that the problem of disinformation is permanently reissued and takes new formats within the digital universe and demands systemic solutions, including the Electoral Justice, which should contribute to an environment of freedom of expression, but keep updating and deliberating with even more agility so as not to be just another side within the digital informational disorder. |
