Resumo: The popularization of the internet and the rise of social medias led to a revolution in the field of communication, promoting a decentralization of content production hubs and the massification of information at high speed and with global reach. This system enabled the formation of a new public space, conducive to the broad exchange of ideas, in addition to breaking down geographical and cultural barriers, providing greater political articulation between different groups in favor of demands of social interest. On the other hand, there is growing concern about the abusive exercise of freedom of expression on social media, such as the circulation of fake news. The large-scale propagation of facts dissociated from reality and science allows the manipulation of opinions, beliefs, perceptions and behaviors of thousands of individuals, including the possibility of influencing the outcome of electoral elections. On social medias, information is created and reproduced without significant third-party filtering, fact checking or editorial judgment, which can compromise the degree of reliability of your content. This creates a crisis in the conception of truth, as a result of the multiplicity of versions of the same fact, often contradictory to each other. From the invention of the press to the emergence of the social media, the relationships that govern social communications have become more complex and sophisticated, demanding the formulation of new solutions in order to conform the Law to the reality that emerges, considering the delicate task of combat he harmful effects of fake news, without, however, threatening the freedom of expression and Democracy
