The present dissertation, through a transdisciplinary study, has the aim to spot on the juridical system and its close relationship with the ideal of safety. Reviewing traditional premises that founded the classic scientific speech of the Law to the light of a new paradigm, that has been established in the Brazilian juridical law, after the promulgation of the Constitution of the Federal Republic of Brazil 1988. Deconstructing the desires such as "truth", "certainty" and "order", and themselves committed with the fetish of "juridical safety", it ingrained to the traditional dogmatic, which institutionalized the vision of a neutral right and without critic, in total mismatch with life itself. Moving away from that modern mechanistic paradigm, based on the created certainty, it intends to focus on the value of juridical safety. It is based on an open, no-linear and chaotic juridical system, that embraces the uncertainty and complexity of the human condition, giving vivacity to the Law through a renewed and committed juridical speech with aim for Justice. Without disrespecting the pattern of previsibility that is no-deterministic and that reveals itself with attractors of the system, they are magnetized in the fundamental rights. |
