The present thesis aims, from critical and reconstructive perspectives, to reconstruct the idea of legitimacy of constitutional adjudication exercised by the Brazilian Supreme Court through the emancipation of the dialogical approach, the democratic understanding of deliberation, and based on a human rights approach. Specifically, the research seeks to problematize the dialogicdeliberative legitimacy as a factor strengthening the democratic legitimacy of constitutional review by the Supreme Court. This is because dialogic-deliberative legitimacy, its method, and techniques promote openness to the participation of social and institutional actors within the judicial decision-making through collective deliberation. It allows for influence, collaboration, cooperation, and integration in the stage of judicial deliberation as well as in the implementation of decision, in order to materialize democratic principles, facilitate the effective exercise of freedoms, and promote substantively inclusive and pedagogical institutions. The proposed theme will be investigated through comparative empirical research, employing inductive and deductive reasoning and adopting techniques of quantitative and qualitative analysis of content and documentary data. Finally, innovative and original contributions to science are presented as the notion of dialogic-deliberative legitimacy of constitutional adjudication, the construction of an index to measure the deliberative performance of constitutional courts based on the methodology presented in the thesis, the dialogic-deliberative method and its resulting techniques |
