Resumo: This paper aims to discuss the choice of the Brazilian State for laicism and its implications in the scope of educational services. The goal is to understand if there is constitutional viability in the performance of confessional education owing the republican choice for the laicism of the State. The justification for this research is given by the apparent impossibility of secularity and confessionality to act harmoniously. It exposes the characteristics of a laic State through the study of its history, showing differences between other forms of relationship between the State and religion, also dealing with the concept and the implications of religious liberty. Then, approaches the relationship between the right of education and religion in constitution, analyzing the Brazilian specificities in the public and private spheres. It seeks to understand how confessional educational institutions work in Brazil, how it relates to society and with the State. Finally, the research is directed to harmonize the laicism and confessional education regarding the constitution.
