Resumo: | The word punishment has always been present in the evolution of humans' history. Until the rise of modernity, the sacrifice of the body was used to punish those who disregarded the social rules of a determined society. With the rise of capitalism, a new form of punishment arose: deprivation of liberty. According to its idealizers, this new model aims at the humanization of the pen, primordial for the re-socialization of the individual. In Brazil, the Penal Execution Act of 1984, based on international laws, seeks to ensure education and work for the deprivation of liberty as the most effective method for the process of social reintegration. Thus, despite legal guarantees, the Brazilian penitentiary system, as in other countries, seems to be failing to achieve its objectives, re-socialization. Recurrence is a reality for most prisoners. Thus, in the midst of a probable crisis in the Brazilian Penitentiary System, reflected in the overcrowding of prisons, in the difficulty of access to justice and in the ill-treatment denounced constantly by human rights organizations, this paper investigates what school education can do to humanize the prison system? Can education emancipate the prisoner so that he can get rid of the widespread vulnerability that condemns him? Finally, what is the objective of the school within the Brazilian prison system? In order to answer these questions, we conducted a field survey at the Cruzeiro do Oeste State Penitentiary, where students and teachers presented their views on the offer of school education within this Criminal Unit. The bibliographic research allowed to construct a brief history on the human rights, emphasizing who are the ones protected by these rights; And on the denial of these rights to those excluded from history, including those deprived of liberty. In addressing the present prison and its evolution since the eighteenth century, it was sought to make a connection between the capitalist rise and the appearance of the prison as a measure of criminal execution. The research also analyzed the profile of those who are deprived of liberty at the PECO and pointed out some difficulties in maintaining the human right, school education, in the prison system. At the end, the importance of working together between the State and society in the struggle for the guarantee of full education capable of emancipating and reinstating the prisoner worthily in society was confirmed, although we conclude that despite the recognition of the great importance of education in intramural life can’t solve a problem that is inherent in the system. Finally, we find that the penitentiary system is nothing more than a reflection of capitalist society that excludes the poor, the woman, the black man, the ex-prisoner, in short, all those who flee from the historically constructed standard and / or from some Private property, reason for being of the economic system in force in Brazil. |
