Resumo: In the current scenario of the labor market, several practices of labor exploitation are developed. Slave labor is the most intense form of exploitation that can exist, since it undermines, almost completely, the subject's possibilities for self-determination. This work aims to discuss the impunity of this crime from the perspective of theories of criminal selectivity and critical criminology and used as a basis the data that only 11.8% of the cases that reached the Federal Regional Court of the 1st Region in the year 2022 resulted in conviction . An analysis of the work was carried out from the perspective of human rights and the guidelines for decent work proposed by the UN were also presented. In addition, it carried out a brief case study about the case of rescued workers from Fazenda Brasil Verde, as well as an analysis of some acquittal judgments of the TRF 1st Region. It also aims to study the theory of penal selectivity and its application by instances of State power. Finally, the legal understanding of the subject, based on the analysis of the critical theory of criminal law, gives rise to the development of more efficient actions aimed at the eradication of slave labor.
