Resumo: | The present research aims to scrutinize, evaluate the consequences and measures of preventive and resolute intervention, on an approved environmental, urban planning, research, technical and technical and scientific problem of occupations that could be legal measures in localities that were previously possible legal areas of long permanent preservation by Federal Law no. 4,771/1965, but with different restrictions, at least protective of the Forest Code in force, Law no. 12,651, of May 25, 2012. In this context, the analysis of the historicity of the urban evolution of water courses in Boa Vista, from its origins to the present, developed with the cumulative step of growth between the necessary environmental protection and the ideal quality of life for a rapidly growing society. Concomitant non-observation, consequences are the reduction of the ciliary political appearance with which the results of poor public observation, of the power phenomena of public and collective flooding that can make an interaction between man and urban biodiversity compatible. non-adoption of stricter future rules on intervention in these spaces and surroundings redundancies in the capacity of resources to society, present and present, and to the natural resources existing in the city. References and weightings were methodologically based on geotechnology and descriptive and descriptive scientific methods via discursive resources, developed with survey, review and bibliographic research, international, national, state and local. For that, the study area of 23,386Km² with preserved flora was arrived at, which is located in the Urban Expansion Area of the left bank of the Cauamé River and involves the difference from the current range of permanent preservation areas to the limit of the greatest flood, registered on June 1, 2011, by the National Water Resources Information System, when the Branco River reached the historic mark of 10.28 meters. The result of this conjunctural analysis made it possible to clarify that, if there is not an adequate confrontation and incisive action by the municipal public power, responsible for the adequate urban planning, due to geomorphological and pedological factors, eminently flat relief, reduced elevation and occasional incidence of more severe flood periods, future real estate developments will be subject to significant social- environmental, urban, cultural and economic encumbrances. Thus, supported by data on the evolution of population growth, the verification of the precarious governmental actions developed and the inefficiency of the applicable legislation, the essential role of planning in spatial occupation was ratified, however built in a collaborative and shared way by the Municipality and society, based on in science and technology. The conclusion of the research highlighted the indispensability of inserting alternative cogent solutions that, through inclusive instruments and implementation of public policies of a notably precautionary nature, are capable of promoting the creation of a protected area in the respective non-anthropized space, able to guarantee the protection of the natural heritage within the urban environment and the aspirations of the community, with the mitigation of risks and their harmful effects, and realization of the right to a sustainable city and unconditional protection of biodiversity. |
