Resumo: | The present work analyzes the way in which the Judicial Power of Rio Grande do Norte acts in the possessory actions, in fact, how it comprehends the struggle for land. In order to do so, it is based on the contributions of Sociology, Political Science and Law, on two significant cases of tenure reintegration involving the Movement of the Landless Rural Workers (MST), one occurring in São Gonçalo do Amarante and another in the city of Touros. From the analysis of the document contents contained in the lawsuits, the general characteristics of the procedures are presented, their remarkable elements and the way they are arranged in the praxis adopted by the judiciary. Those are circumstances that allow us to go beyond the proper procedures to characterize the hegemonic way as the investigated relation can be established. As for the documents analysis results under study, the characteristic that seems to emerge is that it is a simulation to express an already established understanding of three themes: property, the struggle for land and the MST. It verifies that in the procedures a narrative dispute is projected and it exposes its elements in order to understand its operation, mainly regarding the role of the proprietors, the MST, the judge and the promoter and how this materializes in the strategies adopted and in the discussion around the land issue. It understands that the potiguar judiciary acts as maintainer of the private order as indicates that its oriented actions are to the defense of private property as a foundation of hegemonic right and for the defense of private interests according to the patrimonialist logic rooted in the Brazilian State. |
