This master's dissertation aims to explore the intersection of so-called “neuro-rights” with the right to privacy in the Brazilian legal context. The analysis begins with the convergence of legal regulations around the individual, tracing back to historical origins and emphasizing the influence of World War II on the perception of personality rights and human dignity. Amid these reflections, the study highlights the evolution of the idea of the social state and the transformation of the Constitution into a central instrument in the legal system, aimed at valuing the human person. The research seeks to understand how emerging technologies, particularly those related to neuroscience, challenge and reshape traditional notions of privacy and personality rights.
