A aplicabilidade da constelação sistêmica e familiar e sua eficácia enquanto método pacificador de conflitos no âmbito da inovação social nas organizações e no empreendedorismo, com foco no judiciário

Resumo: | Society, in general, faces many conflicts of all kinds: political, social, educational, legal and organizational. Despite the numerous efforts mobilized to solve social problems, success has been difficult to achieve. There is a growing need for new strategies, concepts, approaches and even organizations that can promote solutions and new directions for society's increasingly urgent demands. The general objective of this work was to promote a study on the applicability of Systemic and Family Constellation and its effectiveness as a method of pacifying conflicts, especially in the context of social innovation in organizations and entrepreneurship, with a focus on the judiciary. Thus, it is presented from three published scientific articles, which were developed from bibliographical research on the assumptions and precursors of the method, researches in Portals Capes and Google Scholar, semi-structured interviews with Constellation stakeholders in the judiciary of Minas Gerais and data collection through documents of the Judiciary Center for Conflict Resolution and Citizenship of Belo Horizonte (CEJUSC-BH). The first article is a study on the development of the Systemic and Family Constellation method from its assumptions and historical precursors, also observing its expansion today and by the various life sciences, mainly in Law. The second article introduces concepts about social innovation and Systemic and Family Constellation, bringing discussions about the use of the method in the pacification of legal conflicts, being another conflict mediation tool with a focus on pacification and humanization. The third article brings reflections on the Systemic and Family Constellation related to the concepts of innovation and entrepreneurship, especially in the field of organizations, with a focus on the judiciary, also showing some results of its applicability in this area. In conclusion, the Systemic and Family Constellation method revealed itself as an entrepreneurial and social innovation method that humanizes relationships, enabling a better understanding of the conflict and a more satisfactory solution for the parties involved. Its application at CEJUSC-BH brought positive results with 94.80% satisfaction of the parties who underwent the method, regardless of the agreement reached in the processes. Its importance demands legal regulation, which is already being processed in the National Congress through Bills 9.444/17 and 4.887/20. |
