Resumo: | In Brazilian Law the theory of legal personality is completed by the theory of legal capacities, which explains the ability to acquire rights and to practice acts of the entities to which the susceptibility to be the subject of a right is attributed. This theory enters Brazilian Law through two works of Teixeira de Freitas which are based on theories under development in Portuguese Law, French Law and German Law, but which present concepts and a normative scheme of his own. Freitass concepts and scheme influence Brazilian Law and appear on every project of Civil Code after the Esboço, but in time they are substantially transformed. The scheme finally used in the Civil Code of 1916 ends up representing a summary of Freitass scheme, though the concepts which will later be used to explain it come, above all, from Clovis Bevilaquas reading of the freitian concepts. |
