The dissertation boards the access public politics bases to justice starting from an access global action historical analysis to justice. Evidencing the meaning of the itinerant justice under a perspective of public politics in the national juridical- politician context in the bulge of this movement the. It demonstrates that the Federal Constitution of 1988 established a new paradigm to the fundamental right of access to justice, overcoming the typical conception of Portuguese Liberal State, and simple formal right of propose an action, indifferent to social needs, the access to justice is erected the condition of a indispensable right to protect other right, emerging, therefore, the preoccupation with the social and economic inequalities that pass by your effective exercise. In this context, the study develops a reflection on the need to overcoming of the access obstacles to justice that affect more strongly the population that lives in poverty situation. Among the strategies used to overtake the illusory access line to justice, the investigation it stoops about the Public Defensive, the Special Courts and itinerant justice. Leaving, then for a pragmatic research for implementation in Maranhão s State, of the Federal Itinerant Especial Court program the Justice Winning Distances developed in the scope of the Federal Regional Court of 1 Region. It reflects about the reach of this public politics in the access enlargement to justice in our state, verifying if the perspectives that based its forecast were corresponded.
