Consórcio público Intermunicipal como política pública para enfrentar a questão dos resíduos sólidos urbanos

Resumo: | The present study deals with the issue of urban solid waste (USW), especially as regards the final destination and the intermunicipal public consortium, as a public policy capable to take account of the challenges presented to the Municipalities; reports the situation in the COREDE Missões area and analyzes the case of the Consórcio Intermunicipal de Resíduos Sólidos (CRESU), located in the municipality of Pirapó, and which also includes the Municipalities of São Nicolau, Dezesseis de Novembro and Porto Xavier (which joined posteriorly). This research is divided into three chapters: the first questions the consumer society, ponders the search for development, and focuses on legislation and environmental law as guarantors of the desired sustainability; the second discusses public policies, makes a picture of garbage production and establishes a theoretical debate on attributes present in the Política Nacional de Resíduos Sólidos (PNRS); and the third investigates the consortium as an alternative for public management and examines the process of formation, implementation and maintenance of CRESU. A descending approach is used, based on a methodical application of abductive inferences, with bibliographic review and documentary research being the main techniques for data collection. The results point to the feasibility of the public consortia, which allow for gains in scale, increasing efficiency and capacity of public power, so much so that the four participating Municipalities fulfilled the main goal of PNRS (article 54), which is to eliminate the so-called "dumps", more than a year before the deadline. The 13-year temporal lapse between the foundation and the effective functioning of the CRESU sanitary landfill has as its main cause the difficulty of financing, a common reality to many public policies of national scope and vertical application, such as PNRS, formulated without the guarantee of the respective public resources for its execution. The location of the sanitary landfill is privileged, distant on average 10 kilometers from the founding Municipalities. There is an apparent failure in the USW deposition cell, in the execution of the project or in the management of the landfill, since the volumetric capacity should not have been depleted so quickly, a situation that led the consortium entities to bid the final destination for a private landfill. The conclusion is that, seeing of the structure already in place, the investments made and the need to maintain the environmental liabilities, a detailed study should be carried out with a view to resuming the complete operation of the sanitary landfill with a sorting center. As a suggestion, the continuity of CRESU should be restricted to the founding Municipalities, without the participation of the Municipality of Porto Xavier. |
