Resumo: The aim of this work is to understand the role of political parties as the prerogative of standing to bring legal proceedings for the concentrated control of constitutionality to question the laws approved by the Brazilian Congress. The research will seek to verify the filing of actions before the Supremo Tribunal Federal from parties with different characteristics. For this, we depart from the idea that the judiciary can be the political arena and the Supremo Tribunal Federal an actor with veto power. Thus, it is necessary to first conceive that there is a strategic use of the courts by political actors. At the end, an analysis is made of the party associations performances from the positioning of the in the Legislature and the Judiciary between 1995 and 2010. The purpose is to identifying some of the political and institutional variables influencing the political parties to make use of an alternative judicial. Immediately, depending on the number of shares already proposed in the Supremo Tribunal Federal by the parties, we assume that, Brazilian political parties, in general, have adapted to the use of judicial actions. The research will seek to understand the content of this strategy and its practical consequences.
