Resumo: | Analyzes the problem of extension the authority of res judicata when the plurality of legitimate objection to a single act and the action has your begning only for one legitimized. Presents general considerations on the res judicata and then outlines the evolution of the doctrine concerning the system of limitation of subjective res judicata. Immediately thereafter discourse of treatment dispensed for the paternal legislative about subjective limitation of res judicata in the jurisdiction both in individual and collective in the jurisdiction, when defending the existence of exceptional circumstances where the general rule limiting the subjective res judicata to the parties shall follow the procedure common CPC, is mitigated. Presents the critical point when the work discusses the various doctrinal positions on the issue of subjective limits of res judicata in actions where there is plurality of the legitimate objection to a single act. Examine, critically, each doctrinal position, from the standpoint of constitutional guarantees and the process of legislation, during which supports the formation of the unit necessary joinder of parties, adopting the method of edictal citation using criteria similar to the systems of the opt -in and opt-out, which legitimized to ensure the possibility of joining any of the centers of demand (and even the possibility of not joining in the demand). |
