This research will dedicate to defining the legal nature of mediation as a selfcomposing process and to demonstrate how the fundamental right to a fair trial conforms the scope of legality of extrajudicial mediation. To this end, conceptual premises will be established in order to demonstrate what is meant by a process in the context of extrajudicial mediation and how this self-composing process can be analyzed from the perspective of the fundamental right to a fair process, including investigation and definition of the scope of legality extrajudicial mediation, considering the legal regime regulated by the Civil Procedure Code and law nº 13.140/2015 as part of the Multidoor Justice System.
