The present work intends to resize as rules resulting from a labor reform, Law n. 13,467/2017, analyzing the limits of flexibility in the face of the autonomy of the collective will, fundamental rights and as principle bases of Labor Law. To this end, it follows a path of exponential analysis of fundamental rights and their impact on new aspects of labor law, identified by flexibility and deregulation, these analyzed with a greater focus on the ideals brought by negotiated versus legislated. Then, carry out an analysis of the workday, in particular, regarding the compensatory regime with the most impact on the labor reform, 12x36 workday, and all shipments: full elimination of the interval; no indemnity for Sundays and holidays worked; work in an unhealthy environment, and without the need for authorization from the competent body. Finally, in this new explained industrial order, every approach was established in parallel with a prohibition on social return, the realization of fundamental rights, the monetization of work and the new jurisprudential understandings of the Superior Labor Court |
