Arbitration in the scope of labor relations was introduced into the Brazilian legal system through article 114, paragraph 2, of the Federal Constitution of 1988, and it was intended only as an alternative for the pacification of collective conflicts. In 1996, after many years of arbitration practice inspired in foreign models, the Ordinary Law no. 9,307 (a federal statute passed by simple majority voting) ruled the issue as a whole in Brazil and established in its first article that the doctrine could only be used to solve conflicts concerning waivable rights with proprietary character. From then on, there was a real uproar about its applicability to individual labor relations, which involved unavailable rights. In 2017, the Ordinary Law no. 13,467, the so-called “Labor Reform”, brought an avalanche of transformations in the scope of labor relations, especially overcoming the discussion about arbitration practice in individual labor conflicts through the new article 507-A of the Brazilian Consolidation of Labor Laws (CLT). Nonetheless, the legal controversy was reintroduced, provoking intense arguing and questioning about possible violations of constitutional principles, as well as doubt and insecurity about its applicability on a case-by-case basis. And it was in that scenario that the present dissertation was born, evolved and ended, bringing a relevant reflection on the theme, mainly to formulate a concrete understanding about that legalization |
