Resumo: |
The enactment of the law 12,846, August 1, 2013, was received as an improvement in the consolidation of the Brazilian democratic state. Perfecting the fight against corruption with the formulation of a law specifically geared towards the private sector is a valuable initiative, if the principles of protection of the accused are guaranteed in the Federal Constitution. However, this positive initiative can transfigure into an arbitrary authorization, receding to the State of Police, if their accountability mechanisms are misunderstood. This study evaluates the administrative accountability of the corporation disposed in law 12,846 / 13 in agreement with the dictates of the law within the constitutional principles of Administrative Law Sanctioning, using the technique of interpretation according to the Constitution to attest to the validity of the new legislation forward the constitutional structuring principles of the democratic rule of law |
