Resumo: |
This work is an examination of the theory of legal principles developed by the German jurist Robert Alexy. It seeks to provide a comprehensive account of the structure and content of the theory, commencing with an elucidation of its historical, legal, and theoretical context of development. Furthermore, theoretical debates on the subject are presented, as well as elements regarding the use of this theoretical framework by the Brazilian Supreme Court. The aim is to facilitate reflection on the potential and utility of this theory in the consistent application of contemporary democratic constitutions, particularly that of Brazil, in light of the challenges that emerge amidst the factual and normative complexity of highly pluralistic societies. It concludes by acknowledging the relevance of the contributions it offers, pointing out issues that could be developed or reformulated |
