Objective. This dissertation aims to investigate whether the Labor Law can absorb the modern civilian mechanisms focused on social values for the contract work is viewed from the perspective of its social function and in this context, what is the role of the judiciary in the confrontation of rights and basic values of the conflicts that arise between capital and labor. Justification. It is important and controversial issue, not only by innovations positivist that justify differences in doctrine and jurisprudence, as the profound effects on labor relations. Resizing constitutional elevation to the status of the work of social value, the advancement of the Civil Code reformulated through flexible mechanisms focused on social values and growing with new infra positivation optimal signal design for a new employment contract: it carries on social function. And this new perspective highlights the role of the judiciary that takes the stormy challenge of seeking mechanisms that reconcile the different normative sources for the composition of labor disputes. Theoretical and methodological aspects. For the preparation of this essay different scientific methods were used based on the logical and investigative nature - historical, sociological, dogmatic and comparative. It also adopted the analytic-synthetic method, with analysis of juridical texts for the findings. About the techniques, were made research in legal texts, doctrine and jurisprudence, according to the usual scientific methodology |
