The imprecise wording of article 37, § 6º of the Federal Constitution, gave rise to a wide disagreement about the possibility, for the victim, of inserting the public agent in the passive pole of the lawsuit for civil liability, due to the damage suffered. Thereby, a portion of the doctrine and jurisprudence understands that the referred device established a double guarantee, of reimbursement to the citizen and intangibility to the agent, which, from this perspective, would only respond to the legal entity that is bound, while another part understands that an indemnity by leap is possible, so, the compensation action could be moved directly against the public agent causing the damage, skipping a previous regressive action. In order to resolve this disagreement, the present study analyzes, in a qualitative and exploratory way, the perspectives about the passive legitimacy of the public agent, and, based on the administrative principles that support them, develop, in an objective and detailed way, a solid understanding about the impossibility of a public agent direct responsabilization by the victim, in case of civil liability |
