From the consideration about the perception of justice this paper identify a conception of justice suitable to the contemporary brazilian reality; demonstrating, then, the function of the Civil Process at the accomplishment of this justice; detaching the importance of the law s operators, more specifically of judges, in realize its. Therefore, this dissertation presents a philosophical and semiotic analysis, of the role of the judges in achieving justice through the decision-making process, presenting the phenomenon of Judicial Activism as a result of such activity. For this, we studied the theories of authors such as Chaim Perelman, Ronald Dworkin, Robert Alexy, Charles Sanders Peirce, among others
