Resumo: The present work aims to study the evolution of the work, in particular, in contemporary capitalist society from the standpoint of humanism as set out in the primacy of human dignity. Addresses the transition from the slave past Brazilian society to modern competitive. This analysis demonstrates that the construction process of the capitalist order in Brazil was not uniform. The phase or cycle decisive impact on the formation of working relationships. It goes then to the study of labor Law, especially after the evolution of Human Rights. The constitunalization of the Labor Law, the appreciation of the human being and the private deserved in depth study in order to understand the progress of jushumanism and the decline of legal positivism. In this respect, it is demonstrated that the Federal Constitution of 1988 represented a new paradigma values to be observed in both the public and the private relationships. The social value of work, free enterprise and the primacy of human dignity provided a legal interpretation to the operator whose right to make operational and the social rights. Finally, we evaluate the effectiveness of horizontal two fundamental human rights in concrete cases and the role os the Judiciary in the maximum efficiency of fundamental Human Rights
