The research aims to investigate the alleged failure of the Brazilian State to protect human rights to health and life during the COVID-19 pandemic. The intention is to verify whether it is plausible to invoke the responsibility to protect as a basis for relativizing Brazil's sovereignty and allowing international intervention in the management of the pandemic, especially in relation to failures in the protection of human rights. The study is based on the assumption that state sovereignty can be relativized in favor of human rights, based on the responsibility to protect, which recognizes that the serious violation of human rights can justify international intervention. The research addresses the historical context of debates on the responsibility to protect and highlights the importance of universalizing human rights in the international community. The chapters address topics such as the elements of the State and sovereignty, the expansion of human rights and the role of the UN, human rights to life and health in Brazil, the spread of SARS-COV-2 and the management of the pandemic, the responsibility to protect, the possibility of international intervention and the feasibility of intervention in Brazil. The research aims to make international actors, national institutions and civil society aware of the importance of human rights and the need for an effective international system for their protection. The aim is to pressure states to adhere to this system and, if necessary, allow for international intervention to prevent human rights violations |
