Resumo: The criteria that have served to establish kinship bond, particularly the parentage determinations, have changed over time, with the new paradigma os the socio- affective affiliation gained special relevance in this context. The present research aims to critically analyze the construction and legislative evolution in matters of filiation and the jurisprudential construction on filial relationships established from the socio-affective ties, despite the absence of specific legal basis. Consequently, the possibility of recognizing socio-affective affiliation has bem consolidated in the Courts and also in legal doctrine, which implies legal repercussions reflecting the affiliation ties. In this context, there is a need to explore the doctrinal literature and jurisprudence that contributed to the consolidation of the possibility of recognizing socio-affective affiliation. The succession repercussions, also encounter obstacles in seeking solutions within the current legislation, as these were not conceived at the time of the promulgation of the Civil Code. The problems of academic constructions on the central theme and the difficulty of defining objective and safe criterion for applying the solution proposed by academy and jurisprudence were highlighted. Therefore, we sought to emphasize the inconsistencies between the innovation proposed by doctrine and accepted by jurisprudence and its reflection within legislation. Finally, the work analyzed the proposals of the Commission for Reviewing and Updating the Civil Code, which attempted to fill the legal gaps and propose relevant solutions for the problems previously identified and, even so, some of these issues remained, with the of carefully and critically analyzing the proposals formulated
