The present work has as its starting point the current moment of paradigm change, which directs a new look to people with disabilities and the promotion of their potential, in which accessibility and the breaking of barriers are not limited to the physical aspect, pursuing effective inclusion, in order to allow and stimulate the development of their autonomy, political, cultural, social and family participation, as they are subjects of rights in the national and international legal order. In this context, the advent of Law nº 13.146/2015, the Statute of Persons with Disabilities, brought about profound changes in the theory of civil incapacity and transformed the curatorship into an exceptional measure, introducing the supported decision making institute in the country, a protective measure that preserves the capacity of people with disabilities at the same time that it assists them in the practice of acts of civil life, according to their needs. Because it is a new institute that breaks with the disabling system that existed, many doubts and disbeliefs regarding its application are presented. The objective of the present research will be to understand the effects of this new conception and to formulate a more solid basis for the application of supported decision making, with a systematic interpretation capable of expanding the reach of the institute and fostering its multifaceted impact potential, in line with the spirit of a reform that seeks to overcome the disabling measures of the past |
