Resumo: In view of the change in the disability system in Brazil, resulting from the New York Convention and the subsequent Statute of the Person with Disabilities (Law No. 13,146, of July 6, 2015), art. 3 of the Civil Code of 2002 is revoked, and from that it remains only in the legal system the child completely incapable. Based on this observation, Civil Codes of Europe and Argentina are revisited, only those that inspired the Codes of 1916 and 2002, to identify if in these countries the signing of the New York Convention brought changes in the theory of the incapacities. The conclusion is surprising, when we realize that in all the diplomas analyzed, none of them abandoned the old systems of protection of the incapacitated, keeping intact even the system of nullities of acts practiced by the incapable, as did the new Argentine Civil Code. In Brazil, differently, the complete abandonment of the idealized protection, still in the Filipino Code, to the absolutely incapacitated, on the grounds that it would elevate the status of the dignity and equality of persons with disabilities. From this perspective, the excessive changes promoted by the new theory of incapacities, by Law no. 13166, especially the termination of the absolute incapacity of over sixteen (16) years, violating the 1988 Constitution and the New York Convention, ends up violating the legal security of persons deprived of retracement sealed
