Resumo: |
The reciprocal assistance and protection are inherent to human being and their own nature is based on being gregarious grouped. It is in the very essence of society that human being is. These are the best conditions to explore all its potentialities, developed as a human being and as a last resort, being helpful would be the best condition. Every person is gifted with a human personality, carrier of hankering and needs that must be fulfilled so the person may be able to have an entire and dignified life. Thus, the interest that takes place for one person suddenly becomes the interest of all of them: human dignity pierces the personal sphere and reaches people´s collectivity. If, before all that, protection and assistance takes place in a personal point of view, in the Democratic State of Law, such setting is going to change becoming the State responsibility the achievement of necessary action for the meeting of such needs. Although outdated the Permissive State and the Social Well-being and this last one includes its effective implementation the amount conquered by it, consubstantiate essentially by the fundamental rights that are maintained, not as mere values but truly as positive law inside constitutions. In such path it is necessary the trajectory of fundamental rights in its accumulated dimension such as the dignity study of a human being aiming in outlining what would represent the lowest possible existence. The Social Welfare, object of such current study, comes out in the beginning as an element of Social Security which brings together also Health and social security savings. Although having such scenario highlighted for being recognized as social protection policy and not contributory, meeting this way the amount of needed citizens, the principles surrounded by the Social Welfare such as their elements and features are met. The access to benefits and Social Welfare is a citizenship exercise way of bringing it up and, due to that, the presence and positioning of Judiciary Power is essential to ensure the entire exercise of democracy |
