Resumo: The present doctoral thesis addresses the absence of rational and legal criteria to produce digital evidence, considering that merely analysis of the chain of custody as a criterion for the integrity of the evidence is insufficient. Other limitations, therefore, are necessary. The phase of producing elements of digital evidence, at the time of criminal investigation and during the criminal proceedings, must be observed by the Judiciary as a stage of remediation, in addition to the chain of custody, both aiming to achieve coherence and reliability in the Brazilian criminal process, which is part of the Democratic State of Law, grounded in the dignity of the human person. To date, there is no legal provision for the treatment of digital evidence. The main points of attention are related to verifying the criteria and limits required in the criminal process for producing digital evidence and whether the procedure imposed by the chain of custody provides sufficient benchmarks for safeguarding the integrity of evidence in this mode. The purpose is to identify the rational criteria for its production within the legal framework that supports the acceptance of evidence elements, and to point out alterations or manipulations that may lead to judicial errors. For this analysis, a comparison is made of social evolution with a focus on new technologies, considering the doctrine and forms of contemporary criminality, cybercrimes. It is necessary to identify the current understanding by both the Supreme Federal Court and the Superior Court of Justice regarding the production of digital evidence, analyzing the chain of custody as a limiting factor of evidence elements. Finally, criteria are suggested to assess the integrity of digital evidence
