Resumo: | This paper aims at Distance Education and copyright, as well as its arise around the world and in Brazil, and its development along the last years – including the regulation under article 80 of the ‘Lei de Diretrizes e Bases’, legitimised under Act No. 5. 622, dated August 16th, 2005. However, that new instruction system, the Internet advancement, and the easy access to content found on universities websites and on the Web in general, have led to enquiries about dealing with it and with copyright. The Law No. 9. 610 / 1998 protects the Brazilian authors’ works, by giving them moral and financial rights concerning its creation and contents available at the University Website. This way, the professor starts to perform other roles besides teaching, and starts writing and delivering education to students who are not physically "on site". As the teacher / instructor has been attributed more and diverse tasks, it is necessary to check the contracts of employment for teachers, since the rights are granted to the worker through the relationship employer-employee. The ‘Justiça do Trabalho’ is responsible for avoiding controversies. |
