Resumo: The objective of the present thesis is to identify the amplitude of the constitutional command that prescribes the right to the health. It will be analyzed if the right related are a basic right and which steps of the State can legitimately be demanded from the society. Will be analyzed the positions that can be taken by the Judiciary in our current days, one, more active – in substance (judicial pro-activity), or only that one responsible for the defense and the guarantee of the observance of the legal and constitutional procedures -, trying to identify in which basis we can find Brazil nowadays. On the sequence will be entered the analysis of that it can be demandable of the State, excepting the “reserve of the possible one”. Here it will be work with the theory of the " minimum existencial ", its general configuration and especially in relation to the health, being analyzed in correlation with the limitation of the mount of money of the State, a re-reading of the principle of the separation of the State Powers and the analysis of some concrete cases, where will be presented, to the end, some measures with objective of judicial to accomplish the right to the health, such as: application of penalties for the disobey of sentences, apprehension of public mount of money, judicial allocation of mounts of money in the budget, authorization of tax compensation for the private initiative when judicially compelled to carry through some medical treatment.
