The paper analyzes the evolution of the right to health in the context of fundamental rights and, in parallel, evaluates the growth of access to justice and the role played by the judiciary in the context of public policies relating to services and actions for health in particular, the supply of drugs. Furthermore, we studied and discussed the main obstacles with regard to budgetary impacts resulting from this phenomenon judicial intervention health. And finally, evaluated some lawsuits under the Brazilian and comparative law, which underscored the role of the Public Hearing held by the Supreme Court in 2009 in order to understand the functioning legalization of health worldwide and in Brazil and find solutions for the effectiveness of this right.
