O que significa, que posições legais se firmam internacional e nacionalmente, que pressupostos deverão relevar para a atribuição de proteção à pessoa que denuncia?Intencionalmente, a Diretiva da União Europeia 2019/1937, do Parlamento Europeu e do Conselho, de 23 de outubro de 2019, relativa à proteção das pessoas que denunciam violações do direito da União, explicitou e expressamente atribuiu total irrelevância à motivação do denunciante whistleblower enquanto condição para lhe ser atribuída proteção. Apenas se exigiu, no âmbito de uma compreensível necessidade de garantir denúncias credíveis, que haja motivos razoáveis para crer na veracidade da informação, erradicando, inclusive, a formulação “boa-fé”. Com vista à sua transposição, a Lei n.º 93/2021, de 20 de dezembro, que implementou o Regime Geral de Proteção de Denunciantes de Infrações, optou por exigir que, no momento da denúncia ou da divulgação pública, haja boa-fé e fundamento sério na crença de que as informações denunciadas ou divulgadas são verdadeiras.Com a presente dissertação pretendeu-se analisar criticamente a suprarreferida posição do legislador português, por confronto com as atuas práticas e entendimentos internacionais, assim como com o nosso atual ordenamento jurídico. Em particular, julgou-se pertinente a abordagem do ponto de vista criminal, com recurso ao Código de Processo Penal e ao Código Penal, para melhor compreender se o nosso atual ordenamento jurídico já acautela denúncias falsas, independentemente de ser denunciante whistleblower.The requirement to fulfill the criterion of good faith for whistleblowers has been one of the key points of greatest debate in terms of whistleblowing. What does it mean, what legal positions are established internationally and nationally, what presuppositions should be relevant for the attribution of protection to the person who report it?Intentionally, the Directive (EU) 2019/1937 of the European Parliament and of the Council, of 23 october, on the protection of persons who report breaches of Union law, explicitly and expressly attributed total irrelevance to the whistleblower's motivation as a condition for being granted protection. It only required, as part of an understandable need to guarantee credible denunciations, that the whistleblower have reasonable grounds to believe in the veracity of the information, even eradicating the wording "good faith".With a view to its transposition, Law no. 93/2021, of 20 december, which implemented the General Whistleblower Protection Regime, chose to require that, at the time of reporting or public disclosure, there must be good faith and serious grounds for believing that the information reported or disclosed is true.With this dissertation, we intended to critically analyse the above-mentioned position of the Portuguese legislator, in comparison with current international practices and understandings, as well as with our current legal system.
