Given a set of criteria derived from regulatory gaps, reporting began to be regulated in transversal terms in the context of the European Union by Directive (EU) 2019/1937, of 23 October, and in the portuguese legal system, by Law 93/2021, of 20 December, which transposed the directive and implemented the General Regime for the Protection of Whistleblowers of Infractions (RGPDI). This dissertation proposes an analysis from a labor legal perspective of the role of the worker in disclosing the visible aspects of Union Law that he is aware of in the exercise of the activity, given that he is in the first line, within the organization, to become aware of the conduct imposed who are outside the law. Moreover, it is necessary to assess the level of protection that was granted to the figure of the reporting worker. Firstly, through the articulation of the admissibility of complaints made by the employee considering the requirements arising from the employment contract, regarding the rights and duties involved. To then proceed with the analysis of the level of protection afforded to the whistleblower, particularly in terms of protection against acts of retaliation and support measures that must be within their reach. Notwithstanding the considerations to be made under the Whistleblowing Directive, it is also worth highlighting the position taken by the Portuguese legislator regarding the transposition of the european directive and the possible approach of the RGPDI in relation to the provisions of the National Labor Law, especially in labor disciplinary matters.A temática do whistleblowing tem assumido um papel de destaque nos últimos anos, houve um conjunto de casos paradigmáticos que trouxeram para a esfera pública factos que não eram conhecidos e que comprovavam a prática de irregularidades dentro das instituições governamentais e não governamentais. Face a um conjunto de exigências derivadas de vazios regulamentares, o whistleblowing passou a ser regulado em termos transversais no contexto da União Europeia pela Diretiva (UE) 2019/1937, de 23 de outubro e no ordenamento jurídico português, pela Lei n.º 93/2021, de 20 de dezembro, que transpôs a Diretiva e implementou o Regime Geral de Proteção de Denunciantes de Infrações (RGPDI). Propõe-se na presente dissertação uma análise sob ótica jurídico laboral do papel do trabalhador na denúncia e divulgação das violações do Direito da União que tenha conhecimento no exercício da atividade, dado estar em primeira linha, dentro da organização, para tomar conhecimento das condutas adotadas que estão à margem da lei. Consecutivamente, cumpre aferir o nível de tutela que foi atribuído à figura do trabalhador denunciante. Num primeiro momento, através da articulação da admissibilidade de denúncias realizadas pelo trabalhador face às exigências resultantes do contrato de trabalho, no que concerne aos direitos e deveres implicados. Para, então, posteriormente proceder à análise do nível de proteção conferida ao whistleblower, designadamente em sede de proteção contra atos de retaliação e de medidas de apoio que deverão estar ao seu alcance.
