Para tanto, buscaremos percorrer as questões gerais que circundam o tema, para que se possa perceber o particular relevo que assume o debate sobre o aborto nas esferas jurídicas, mais precisamente à que toca ao âmbito penal e constitucional. Investigaremos também a evolução legislativa que se deu em torno da interrupção voluntária da gravidez em Portugal, bem como o posicionamento desenvolvido pela jurisprudência constitucional nacional na matéria. Finalmente, buscaremos traçar a íntima relação que se apreende, em matéria de aborto, entre o Direito Penal e o Direito Constitucional, especificamente no tocante à inviolabilidade da vida humana declarada pelo artigo nº 24º da Constituição da República Portuguesa e a constitucionalidade de sistemas divergentes da punição plena. O que se buscará, ao final desta investigação, é de esclarecer o vínculo intrínseco entre os estudos de política criminal que envolvem o tema de aborto, o respetivo incentivo que tais reflexões conferem às mudanças legislativas e a consequente necessidade de admissibilidade constitucional destas propostas, de forma que seja possível defender um sistema regulador legítimo em matéria de interrupção voluntária da gravidez. O debate em torno de um tema acalorado como se revela o aborto, ao menos na sua perspetiva jurídica, depende de estudos aprofundados e justificados para que se possa advogar em favor de qualquer solução.The aim of this dissertation is to analyze the phenomenon of voluntary termination of pregnancy, specifically with regard to its legal-constitutional conformity. To this end, we will seek to go through the general issues surrounding the theme, so that during the development of this research, we can perceive the particular importance that the debate on abortion in the legal spheres assumes, more precisely the criminal and constitutional spheres. We will also investigate the legislative evolution around the voluntary termination of pregnancy in Portugal, as well as the position developed by the national constitutional jurisprudence. Finally, we will try to trace and reflect the intimate relationship between criminal law and constitutional law when it comes to the debate around abortion, specifically on the concern about human life inviolability declared by the Article 24th of the Constitution of Portuguese Republic and the debate around the constitutionality of systems divergent of full punishment. It will be sought in the course of this investigation the intrinsic link between the studies in criminal policy that concerns the theme of abortion, the respective incentive that such reflections confer to legislative changes and the consequent need for constitutional admissibility of such proposals in order to have a legitimate regulatory system on voluntary interruption of pregnancy so that it can be possible to defend a legitimate regulatory system.
