Resumo: This Dissertation is part of the Social Dimensions and Power Relations Research Line. This line involves the theme of democracy in the paradigm of the contemporary Constitutional State, with emphasis, among other themes, on the role of new social subjects that are part of this new form of State and Constitution, as well as on justice systems and the solution through new paradigms that provide effective judicial protection. Using a pragmatic-systemic method, the research in question aims to present the problem of the hijacking of democratic processes by populist leaders who build magnetic charismas in the nomos of social networks, especially through the strategic and cascading dissemination of fake news and post-truths. Furthermore, strategies for tackling the problem will be presented, based on the systemic action of law, economics and politics, within a logic of legal pluralism, in which the principle of responsibility must function as an ethical guide for action. directly from the companies that control social networks.
