Resumo: The present research focuses on the theme of the construction of the right to the city, highlighting the role of the legal system and the existing legal instruments for the realization of that right. As it is well known, although there is a legal provision capable of ensuring the basic rights of city dwellers, there is a practical difficulty in implementing what is enshrined in the legal system, whether by lack of knowledge of the importance of participation or by obstacles in own enforcement powers. In this way, it is important to search for reasons in which certain standards are not effective, to try to glimpse ways to achieve access to basic rights, that also ensure the right to the city, based on full participation and experience un the city in its everyday practices of all city dwellers, not just those richest and most favored by the best locations in the city. The general objective of the research aimed at verifying the capacity of local urban planning legislation to influence the implementation of the right to the city in Ituiutaba-MG. Regarding to the specific objectives, we sought to analyze the existing legal instruments in municipal legislation, beyond to collecting information about their implementation, to verify ways to enforce the law's purpose and thus carry out studies and researchs about the necessary change in the lived experience in cities. Therefore, interviews were conducted with agents of the Public Ministry, the City Council and the Federal University of Uberlândia, who were directly involved in the revision of the Master Plan, for the purpose of deepening the analysis about the urban legislation production in Ituiutaba and the feasibility of its effectiveness. Regarding of the methodological procedures, it is about a dissertation research, of a bibliographic and documentary nature, focused on predominantly qualitative data. Lastly, some proposals were suggested with a view to overcoming the obstacles found, among which stands out the need of encourage popular participation, so that there is greater social control, thereunto, it is essential to invest in education in general. In relation to the main conclusions of the study, it is noted that social and structural factors of the own municipal administration are capable of influencing the non-implementation of legal instruments foreseen in the Master Plan and the own right to the city. In that regard, it was pointed out the need for investment in human resources, qualification and investments by municipal management wherefore they are capable of effective urban planning and management, beyond to highlighting the importance of the role of the Public Ministry as an ally in the defense of the urban order, covering several relevant issues related to urban planning, including the Master Plan.
