Compreendendo o Organizational Misbehaviour na gestão pública: um estudo de caso em uma instituição de ensino superior pública

Resumo: Unethical conduct and inappropriate behaviors in public management in Brazil is not a peculiarity of the XXI Century (MOURA, 2012). The model of colonization applied in the country had the characteristic methodical and systematic exploration for about 300 years, the absence of distinction between the public and the private, besides the practice of privileging allies and individuals based on family ties and friendship. Corruption, bribery, fraud and robbery, among other unethical behaviors, represent a decrease in investment, increase the risks and uncertainties of the country, damage the commercial reputation, slow economic growth, cause financial losses, destroy the image and reputation of organizations, nurture conduits that are harmful to economic and social development, and still contribute to the disbelief of the population in governments (LEVY, DRAGO, 2005; SANTOS et al., 2012; YAO & AHLSTROM, 2014). In this context, this paper aims to analyze the types of organizational misbehavior identified in the management of the Federal University of Uberlândia, aiming at proposing the implementation of a compliance program. The concept used in this research for the definition of organizational misbehavior is proposed by Vardi and Wiener (1996, p.151) as "any intentional action by members of organizations that violates (a) organizational norms and expectations, and / or any intentional action that violates (b) standard values and social mores with inadequate conduct. " The research is characterized as qualitative, being the case study adopted as method of procedure, and the data collection was done through the semi-structured interview and documentary source. It was identified that the bad behavior in the Federal University of Uberlândia is manifested as follows: (1) Irregularities defined in regulations or regulations, fraud in bids or contracts; (2) Disappearance or loss of public property; (3) Absence or unlawfulness of duty; (4) Lack of civility, scandalous conduct, public incontinence, manifestation of appreciation or disapproval; (5) Absence of readiness in activities or in the provision of information; (6) Harassment; (7) Failure to fulfill the duties of the position; (8) Lack of commitment to the institution; (9) Use of public assets for private interests; (10) Corporatism; (11) Undue accumulation of charges; and (12) Insubordination. As a result of the bad behaviors, four consequences have been identified that negatively impact the institution and, consequently, society. As main negative consequences, they were presented: (1) Negative image of the university; (2) Student retention and avoidance; (3) Lack of efficiency and, (4) Financial losses. Finally, considering the specific objective of proposing the implementation of a compliance program and based on the analyzes made, it was possible to conclude that the Federal University of Uberlândia presents itself legally and structurally equipped to implement the compliance program as a management tool for prevention and control of inappropriate behaviors in their organizational environment. It has also been identified that most of UFU's public servants are made up of public agents who perform their duties in compliance with the institution's standards. Finally, as a technological product, in addition to the diagnosis and analysis of the bases for implementation of a compliance program, it is proposed to hold a Workshop to pulverize the knowledge of this research among the administrative leadership of the Federal University of Uberlândia.
