Resumo: Faced with the globalization of cultures and bringing citizens closer contact with different parts of the globe, the need more and more actively participate in individual's in political discussions of his country to realize their citizenship and thus ensure the effectiveness of their rights of popular participation, it becomes irrefutable. Thus, front of the emergence of the information society there are several scenarios that enable the implementation of citizens allies to digital media practices, such as social events that include information and communication technologies as a coordinating and enabling greater flow to the right to citizenship, and also portals that imply a interactivity of citizens in filing and thrust of legislative issues, in particular the right to education and its features, such as the portal e-Citizenship (on the Senate) and the Avaaz site. In this scenario the main objective of the research is to verify that deliberation is present and can be extremely significant even reveal regarding the reconstruction of democracy, resulting in higher levels of popular participation and thus a maturing of the recent Brazilian democracy. Therefore, the methodology used is the phenomenology, is making use of a hermeneutic aspect. In addition, use is made of the methods of monographic procedure and functionalist, as an analytical basis for recognizing cases of participation in sites listed on the right of the topic to education. Regarding the technique is used in a non-participatory systematic observation of public consultations, with tables, fichamentos and doctrinal deepening. The basic theory that guides the study is hermeneutics, with the works of Roberto Gargarella, Carlos Santiago Nino and Jurgen Habermas on deliberative democracy beyond, Perez Luño and Piere Levy on digital nuances of citizenship. The division of labor occurs in two topics, focusing at first a doctrinal and structural support of the analysis categories of participation and democracy, for the second time to bring the observations in the citizen insertion sites as part of a deliberative process that implies possible standards of education in the Brazilian legal system.
