A valorização dos produtos tradicionais através da indicação geográfica : o potencial do aratu de Santa Luzia do Itanhy

Resumo: This work aimed to collect information and features that could demonstrate the potential of the aratu, small reddish color crustacean that lives in mangrove swamps and are incorporated into the cuisine of northeastern Brazil, produced in Santa Luzia do Itanhy/SE for the geographical indication registration. A geographical indication is a legal institution that is part of the mechanism of intellectual property, and translates into an important tool in the quest for protection and recovery of goods and products linked to its territory of origin. Although the term geographical indication has a recent legal concept, it has ancient origins, since from time immemorial men seek for products and services related to a particular region. A geographical indication is a matter dealt at international level and there are many treaties and agreements that deal with the matter, the main one is the Agreement on International Property Rights Related to Trade (TRIPs). In Brazil, the geographical indication is regulated by Law No. 9279/1996, in articles 176-182, being the National Institute of Industrial Property (INPI) responsible to establish the procedures and conditions related to the registry. The geographical indication is one of the few legal instruments of the country capable of protecting traditional knowledge, and adding value to products arising from that knowledge, placing them in different market niches and thus contributing to sustainable rural development. The field research focused on the village of Rua da Palha, located in a rural area of Santa Luzia do Itanhy/SE and focuses on aratu fishing, activity carried out by women for generations, through the practices and traditional knowledge acquired by means of ancestry. Although the research revealed characteristics that point to aratu potential for geographical indications registry, for this option to be viable it will be necessary go a long way, which can only be followed by government support.
