A construção de estratégias argumentativas no tribunal do júri: uma proposta dialógico-discursiva

Resumo: This research investigates the creation of persuasion in accusation and defense discourses in The Court of Law. Especially, the thesis intends to prove the manner how discursive layers are constituted argumentatively as strategies. The study is grounded on Aristotle’ Rhetoric and Dialogical Language Theory (DLT), for the reason of, in the first, having theoretical elements to support the explanation of passions, ethic character, and the manner how orators organize the arguments, and create feelings in the discourse; and for the reason of, in the second, conceiving the utterance as a typical concrete unit, impregnated of voices, produced in the social places as responses of the subjects in the context of interection. Since the research verifies discourses in the discourse, the interlace of these theories, on the one hand, supports the emotional, ethic and demonstrative whole that orators perform the orchestration of the voices that are reflected and refracted in the accusation and defense. The problem formulation institutes the general objective of investigating the dialogue determination in the ways of constructing Argumentative Structures (AS) as layers composition in accusation and defense discourses. The specific objectives intend (1) to identify the ways of constructing AS; (2) to identify the performance of dialogical relations in the ways of constructing AS; (3) to examine the effect of dialogue in the texture of AS; and (4) to describe the argumentation texture in the way of constructing AS. To achieve these objectives the following questions were formulated: (1) in which way does dialogue constitute AS? (2) What dialogical elements can be reflected and refracted in the ways of constructing AS? (3) What effects does dialogue establish in the way of constructing EA? Methodologically, the work is organized in the following way: the Sociological Method and a qualitative interpretative research directed the study; the corpus was composed by one (01) criminal accusation and one (01) criminal defense recorded in a popular jury, on April, 24th, 2017, in the town of Alagoinha, Paraíba, Brazil, in reason of a criminal action of a qualified homicide, disposed in the process number 0001304-73.2016.815.0521; to collect the discursive productions, a digital recorder (Mini Digital Recorder Sony ICD-PX333) was used. As a result, it was verified that, in the accusation and defense, the ways of constructing AS are constituted argumentatively due to determination of lawsuit acts constitution, the jury concrete case, the grand jury; the stylistic construction that organizes and determines the enunciative arrangements; the dialogical layers that instance the relation of otherness as the place of listening, evaluation, comprehension and responsive attitude; and the determination of interactional aspects of time and space.
