Acumulação de cargos e empregos: uma análise à luz do art. 37 da Constituição Federal e demais previsões legais nas universidades federais

Resumo: | Following the promulgation of the 1988 Federal Constitution, Article 37 specifically prohibited the accumulation of positions within the public administration, with exceptions for teaching positions, either in the case of the accumulation of two positions or the accumulation with another of a technical or scientific nature, or in the case of positions or jobs held by health professionals with regulated professions. At Federal Universities, accumulation is a recurring theme in educational management, given that their staff is made up of teachers and administrative technicians who fall within some of the exceptions contained in the CF/1988 and other legal provisions, such as judges and elective positions. However, the wording of art. 37 does not seem to take into account the diversity and complexity of the situations found in universities, which ends up causing doubts and generating problem situations when it comes to civil servants accumulating positions. Control bodies have acted to curb illicit accumulation practices and over the last few decades many decisions and documents have been drawn up to provide a better understanding of the accumulation of positions. The aim of this study is to map out the most pertinent problem situations in federal universities with regard to the accumulation of positions and jobs. The object of study covers 6 (six) federal universities in the states of Paraíba, Pernambuco and Rio Grande do Norte. The approach taken in this study is quantitative and qualitative. Its nature is applied research. In terms of objectives, the approach is exploratory research, which is considered the most appropriate way to verify the relationship between universities and the applicability of Article 37 of the Federal Constitution. As for the technical procedures, the field research involves collecting data by searching all the websites of the institutions chosen, as well as consulting the ombudsman's offices of the respective institutions. To support this study, data was collected from the literature through a Systematic Literature Review (SLR) of the work and research on the subject. Based on the material selected in the SLR, the theoretical framework that underpins the theme of the accumulation of positions within federal universities. Finally, as the end product of this research, a Manual on the Accumulation of Positions and Jobs will be drawn up for the Federal University of Campina Grande in order to contribute to university management to resolve doubts and solve problems regarding the accumulation of positions, observing the problem situations within the author's work environment. |
