Resumo: This work has for objective to analyze the legal protection concerned to women in situation of violence, through the regressive actions in domestic violence proposals in Federal Court. The methodology adopted was case study, with the use of content analysis to cases, a technique that won best suited to the object of research. Violence against women is violation of human rights and its widespread practice by patriarchy was absorbed within society. The feminist movement has crowned by making public the intimacy tainted by violence and enter the topic in international agendas and gradually in the internal systems. In Brazil, although the proclamation of Maria da Penha Law (Law nº 11.340/2006) has represented a landmark in this protection, the State is still being structured to meet the needs of the minority. The Nacional Institute for Social Insurance, through the recent regressive actions, seeks reimbursement to public coffers of social security benefits granted by a result of unlawful acts committed by a third party against the women protected by social insurance, as well as aims to contribute with the punitive-educational for the formation of a culture of non-violence.
