Resumo: This work analyzes the process of institutionalization of children with 0-5 years of age, by measuring the host institution, considering the human right to child education in the city of João Pessoa / PB. It reflects on the role of the Brazilian State in the formulation of public policies, among them the educational policy, with emphasis on early childhood education in order to materialize the rights of children, with a view to full protection (Constitution of Brazil of 1988, Article 227). It believes that the decision of residential care has been much more a process of blind denial of child rights. It recognizes that the right to integrate early childhood education, moreover, the right to community living, to complement the right to family life. It argues that the host institution figure as a symbol of the failure of the state. It believes that ensuring human rights, among these early childhood education, is effective measure to protect children and may contribute to that are not institutionalized, since education is a human right end in itself and means for achieving other rights, amid the struggle to democratize the right to education. Of the twelve institutional placement organizations in the city of João Pessoa/PB that participated initially, four were involved in all stages of research. We conducted interviews and reports were analyzed using qualitative procedures of categorization and content analysis. We also use documents containing information about the process of institutionalization of children. As the host institution has the character of the provisional and exceptional and must be well beyond the law. The study reveals, among other things, that the network of care to children struggling to function effectively, the idea of trampling System of Guarantee of Rights of Children and Adolescents. The institutional placement organizations outside the duty to protect children bump into difficulties like lack/inadequacy of effective public policies.
