Resumo: The existing structure in Brazil is a result Of our historical formation process, in which land ownership was and is synonymous with social status. The relevance that this individual right assumes in the legal system distune with the others and cadence relations with nature, taken as, until recently, just as a source of resources subject to appropriation by the landlord. With increasing environmental awareness worldwide Brazil also edited regulations for the protection of its natural resources, being the largest exponent the Federal Constitution of 1988, which elevated the environment balanced to a prominent position detached from private property to be considered equity for all, including future generations (Well diffused in nature). This, however, has not appeased the historical roots Of our formation as a society, in which land and nature are objects of submission to man, creating a strong dispute between environmentalists and large farmers. Recently, with the event of Federal Law n. 12.651 of 2012, the family farming was brought to this debate, serving as justification, by these large farmers, for the adoption of more flexible criteria to the agribusiness sector. The employed speech of favoritism to family agriculture, segment of recognized importance in food production and generating jobs, but that always faces dificulties due to the low price of its products, insuficient rural credit, land concentration and subordination Of the land to capital income. The research, however, reveals that the advantages are intended not only to family farmers, but mainly promote the representatives Of agribusiness, which makes what would be an advantage for family agriculture at a risk to the segment and to an ecologically balanced environment.
