Resumo: This dissertation seeks to investigate, under a predominantly juridical and theorical approach of the monographic, documentary and bibliographical research, which are the possible reframing’s of the constitutionalism’s scene, considering that the standards established by the constitutionalist movement, programed for the protection of a certain political and philosophical community, presents, nowadays, fractures and gaps not only in their cosmopolitan structure, but also in the diachronic (interspecies) composition of the subjects of justice. Mediated by a theoretical syncretism, it will be developed a hypothesis of a performative reading that, destabilizing its central particles, redirects the driving axis of the so-called fractal constitutionalism. Foremost, we seek to attach speculative expedients that, along with remodeling the potential malaise of modernity, assaulted by the processes of globalizations, offers paths that realign the constitutional operational structure. Furthermore, we outline the diachronic difficulties of the moral community inserted in the political project of constitutionalism, whose absences demonstrate a temporal and spatial distance from (non) subjects, overshadowing the frontiers of justice and demanding an expansion of the interspecies moral circle. Lastly, we aim to partially rebuild this fragmented scenario through an evaluative horizon that, inspiring itself in homologous experiences, favors a new framework, in continuous improvement, for the frame of constitutionalism, applying, episodically, such key of reading on the paradigm of the Constitution of the Federative Republic of Brazil of 1988.
