Resumo: The dissertation aims to analyze the effectiveness of the right to a healthy and safe work environment and the adequacy of social dialogue technique to increase this effectiveness. The proposed analysis is focused on the economic area of the construction and proposes parameters to apply the National Security Policy and Health at Work (Decree No. 7.602 / 2011). In order to do it, the dissertation develops an analysis of the profile of the construction workers, the economic dynamics of the sector. The National Security Policy and Health at Work will also be analyzed, from the ILO Conventions that led its edition to the current lack of political will to its implementation as well as the enact of the National Security and Health Plan at Work as mere compliance with ILO determinations and unaccompanied by any effective measure. Nevertheless, the work's propositional focus lies is in the goals 5 and 7 of PLANSAT that addresses the production and share of health and safety knowledge in online platforms and workers training based on the social dialogue technique and its proper instrumentalization as a means to overcome the lack of political will of elected representatives. As an example to be followed, the work also presents an analysis of the tripartite council of the Núcleo Intersindical de Conciliação Trabalhista, an institution and legal institute under Article 625-H of the Consolidated Labor Laws, which demonstrates the proper institutional environment to apply the social dialogue technique as proposed.
