“Esse povo mata mesmo”: biopolítica e cisnormatividade nas audiências de custódia

The aim of this master's thesis was to analyze the practices of custody hearings in relation to the experiences of transvestites and transsexuals and seek, through these practices, to understand the the operationalization of biopolitical devices. The data presented in this search are the result of an “in-depth research” carried out on the Custody Hearings, in Belo Horizonte, over two years (2020 and 2021). I mobilize the theoretical apparatus to understand how gender and criminal dispositives move practices in custody hearings, based on the following elements: the gender-offender category; the civil name and social name of the transvestite and transsexual people and the alternative measures of the prison, with a focus on social assistance carried out by the “Multidisciplinary Monitoring Team”. I pursue the hypothesis that the cisnormative practices of the custody hearing are inserted in a legal system that is a fundamental part of State racism, of a biopolitics that merges with the old sovereign power of death.
